These Terms of Use (“Terms”) govern your use of the Well Tracker mobile application (the “App”), operated by Volodymyr Dudchak, Private Entrepreneur (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
By accessing or using Well Tracker, you confirm that you are at least 13 years of age (or the applicable age of consent in your jurisdiction) and that you accept and agree to comply with these Terms. If you are using the App on behalf of another person, you represent that you have authority to bind them to these Terms.
Well Tracker is a health and wellness tracking application that allows users to monitor personal health metrics through integration with Apple Health (HealthKit) and manual check-ins (mood, energy levels, and other wellness indicators). The App provides insights, trends, and summaries based on the data you provide.
To use certain features of the App, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

Well Tracker is not a medical device and does not provide medical advice, diagnosis, or treatment. The information displayed in the App, including health metrics, trends, and insights, is for general informational and wellness tracking purposes only.
You should not rely on the App as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information presented in the App.
If you think you may have a medical emergency, call your doctor or emergency services immediately.
The App integrates with Apple Health (HealthKit) to read health data you authorize. By granting access, you acknowledge that the accuracy of this data depends on your device’s sensors and Apple Health’s data sources. We are not responsible for the accuracy or completeness of data obtained through HealthKit.
You may revoke the App’s access to Apple Health at any time through your device’s Settings.

By using the App, you acknowledge and consent to the use of these third-party services as described above and in our Privacy Policy. The output generated by AI services is for informational purposes only and does not constitute medical or professional advice.
All content, design, graphics, branding, code, and other materials in the App are owned by or licensed to Volodymyr Dudchak and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App or its content.
You retain ownership of the personal data and check-in information you submit to the App.
Any content you submit through the App (such as check-in notes or feedback) remains yours. By submitting content, you grant us a limited, non-exclusive license to use it solely for the purpose of providing and improving the App’s services.
You are responsible for ensuring that any content you submit does not violate the rights of third parties or any applicable laws.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.
We strive to keep the App available and functional, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice.
We may release updates to the App from time to time. Some updates may be required for continued use. You are responsible for keeping the App updated.
To the maximum extent permitted by applicable law:
You agree to indemnify, defend, and hold harmless Volodymyr Dudchak from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App or violation of these Terms.
You may stop using the App at any time and delete your account through the App’s settings. We may terminate or suspend your access to the App at our discretion if you violate these Terms or for any other reason, with or without notice.
Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (such as Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of Ukraine.
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms within the App and updating the “Last Updated” date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, please stop using the App.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
